This End User License Agreement ("Agreement") is between you ("User") and Piotr Adryjańczyk ("Author"), governing your use of Lumitag ("Software").
While this Agreement is between you and the Author regarding the use of the Software, the actual sale and payment processing are handled by our Merchant of Record, Paddle.com.
By installing or using the Software, you agree to this Agreement.
The Author grants you a non-exclusive, non-transferable, revocable license to install and use the Software on one (1) computer for personal or commercial purposes.
PL: Autor udziela niewyłącznej, niezbywalnej licencji na użytkowanie Oprogramowania na jednym komputerze, do celów osobistych lub komercyjnych. Darmowa wersja: limit 100 zdjęć. Płatna licencja: 1 licencja = 1 użytkownik.
You may not:
PL: Zabrania się redystrybucji, sprzedaży, sublicencjonowania, dekompilacji oraz inżynierii wstecznej Oprogramowania.
The Software and all associated materials are the intellectual property of the Author. This Agreement does not transfer any ownership rights to you.
The Software includes open-source components listed in THIRD_PARTY_LICENSES.txt (included with the installation). Those components are governed by their respective licenses.
AI models are downloaded from HuggingFace at first launch and are subject to their own license terms.
To the maximum extent permitted by applicable law, the Software is provided "AS IS", without warranty of any kind, express or implied, including but not limited to fitness for a particular purpose or non-infringement.
If you are a consumer, this disclaimer does not affect your statutory rights under the consumer protection laws of your jurisdiction.
PL: W maksymalnym zakresie dozwolonym przez prawo, Oprogramowanie dostarczane jest bez jakiejkolwiek gwarancji. Prawa konsumenckie wynikające z przepisów prawa pozostają nienaruszone.
To the maximum extent permitted by applicable law, the Author's total liability under this Agreement shall not exceed the amount you paid for the license.
If you are a consumer, this limitation does not affect your statutory rights under the consumer protection laws of your jurisdiction.
PL: Maksymalna odpowiedzialność autora ograniczona jest do kwoty zapłaconej za licencję. Prawa konsumenckie pozostają nienaruszone.
This license is effective until terminated. It terminates automatically if you breach any term of this Agreement. Upon termination, you must uninstall the Software and destroy all copies.
The Author may also terminate this Agreement at any time with 30 days' written notice.
Purchases are processed by Paddle.com (Merchant of Record). Your right to withdraw from the purchase and request a refund is governed by Paddle's terms of service. For digital content (such as a license key), the right of withdrawal generally expires upon activation of the license, in accordance with EU Directive 2011/83/EU.
To request a refund or review your rights, please contact Paddle directly or email the Author.
PL: Zakupy obsługuje Paddle.com. Prawo do zwrotu reguluje regulamin Paddle. W przypadku produktów cyfrowych prawo do odstąpienia wygasa po aktywacji licencji.
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
The Author reserves the right to modify this Agreement at any time. Changes will be posted on the website. Continued use of the Software after updates constitutes acceptance of the new terms.
This Agreement is governed by the laws of the Republic of Poland. Any disputes shall be resolved by the courts of competent jurisdiction in Poland.
For EU consumers: this does not affect your statutory rights under the consumer protection laws of your country of residence.
